Decree: 679/2.025 y 867/2.025.- Resolution: 38.620.-
Concordia, July 4, 2025
HAVING SEEN
The need for the Municipality to regulate the exercise of the activities of union leaders and delegates belonging to trade union associations that represent personnel providing services to the Municipal State and;
CONSIDERING:
That it is necessary to regulate at the local level the activity of union leaders and delegates belonging to trade union associations that represent personnel providing services within the scope of the Municipality of Concordia.-
That it is considered convenient to issue a regulation on the matter, in order to provide greater agility to the form and manner in which union activities will be carried out within the Municipality of Concordia, while guaranteeing all the rights that the regulations of Law 23.551 and its regulatory norms guarantee to both the union side and the employer.-
That the issuance of this measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Article 107, subsection u of Provincial Law No. 10.027 and its amendments, -Municipality Regime of Entre Ríos-.
Therefore,
THE MUNICIPAL PRESIDENT
DECREES:
ARTICLE 1.- It is provided that the present norm contained in this Decree shall be applicable to trade union associations that employ municipal public employees, whatever the nature of their tasks, and provided that their relationship is not governed by the Employment Contract Law.-
ARTICLE 2.- Trade Union Entities must reliably communicate to the Human Resources Directorate and the Government Secretariat the appointments of Municipal employees to occupy elective or representative positions in said entities, within ten (10) business days of being made, which will not be recognized if this is not done, leaving the Municipal State released from the obligations arising therefrom.-
ARTICLE 3.- Agents who were elected or appointed to hold positions as incumbents in the Executive Commissions of Trade Union Associations shall enjoy the leaves provided for in Article 48 of Law 23.551 for the duration of their mandate. If the appointment falls upon temporary personnel providing services through service contracts, works contracts, or any other form of appointment that implies transience in the position, once the employment relationship has ended, the obligations of the State shall be extinguished, this being just cause that makes the request for exclusion from the guarantees of union protection appropriate.-
ARTICLE 4.- Trade Union Associations must communicate with ten (10) calendar days' notice to the Government Secretariat and the Human Resources Directorate, Autarkic Entities, and decentralized agencies, the holding of elections, assemblies, and ordinary congresses. When it concerns extraordinary assemblies or congresses, the communication may be made with 72 hours' notice.-
ARTICLE 5.- Sectoral Assemblies of an informative nature and/or referring to labor matters, in which only the personnel of the sector in which they are held will participate, must be notified in writing at least 48 hours before their realization, stating the date and time of realization, to the agency to which the participating agents belong. Likewise, said Assemblies must be held outside of public service hours and exclusively within the respective workplaces.-
ARTICLE 6.- It is provided that non-compliance with the provisions of Article 5 shall be considered an administrative offense and will give rise to the substantiation of the pertinent proceedings provided for in the respective statutes to which the agents in question belong.-
ARTICLE 7.- The heads of the respective areas shall set the public service hours, allowing the use of one hour for the holding of Sectoral Assemblies, which shall be carried out at the beginning or at the end of the workday.-
ARTICLE 8.- Personnel Delegates shall enjoy a maximum of twenty (20) hours per month, non-cumulative, for the fulfillment of their functions, which shall be requested before the Agency where the agent provides services, which shall keep a file of the requests made and the justifications issued for that purpose by the trade union entity to which they belong.-
ARTICLE 9.- Agents who were elected or appointed to hold incumbent positions in the Executive Commissions of Trade Union Associations shall enjoy the leave provided for in Article 48 of Law 23.551 for the duration of their mandate.-
