DECREE No. 243/2.026.

HAVING SEEN, the Note dated 03/18/2.026 and its Annex, submitted by the Coordination of the Control and Supervision Unit, regarding Public Tender No. 09/2.026, for the work “PROVISION OF MATERIALS AND LABOR FOR THE REPAVING OF RICARDO ROJAS STREETS BETWEEN CONCEJAL VEIGA AND DIAMANTE”, Digital Purchase administrative case file No. 1977; and,
 
CONSIDERING:
That, in the aforementioned Note, it is requested to include in the Terms and Conditions of Public Tender No. 09/2.026 an Article that contemplates Price Redeterminations, given the current global context with the development of a war that affects the value of fuels and therefore its derivative asphalt, inputs of high incidence in this type of work, also taking into account the work term of the same, 120 days, which would cause bidders not to submit or to estimate values that could not be adjusted to reality, and the corresponding Weighting Structure, which is attached as an Annex, and the Article must be drafted as follows:
“ARTICLE No.: PRICE REDETERMINATION: It shall be carried out in accordance with Decree No. 2.155/24 MPIyS and its amendment Decree No. 3.480 MPIyS.”
That, likewise, it requests an extension of the Opening of Bids for a period of ten consecutive days, so that bidders who have not continued with the study of the Terms and Conditions due to the situation mentioned above, can evaluate it.
That through Decree No. 126/2.026, dated February 19, 2.026 and through Decree No. 216/2.026, dated March 11, 2.026, the documentation for the First Call and Second Call, respectively, was approved, Public Tender No. 09/2.026, for the work “PROVISION OF MATERIALS AND LABOR FOR THE REPAVING OF RICARDO ROJAS STREETS BETWEEN CONCEJAL VEIGA AND DIAMANTE”, whose background information is in the Digital Purchase administrative case file No. 1977 of the year 2.026.
That for the reasons invoked, this Executive Department deems it appropriate to grant the extension of the Opening of Bids, for a period of Ten (10) consecutive days, from the date set by the Directorate of Purchases and Supplies, as well as to order the approval of the new Terms and Conditions and the Weighting Structure, which forms part as an Annex to this Decree, of Public Tender No. 09/2.026, for the work “PROVISION OF MATERIALS AND LABOR FOR THE REPAVING OF RICARDO ROJAS STREETS BETWEEN CONCEJAL VEIGA AND DIAMANTE”.
That the issuance of the measure is carried out in use of the powers conferred upon the Municipal Executive Department by Article 107, subsections ñ), q) and u), of Law No. 10.027 and its amendment - Regime of the Municipalities of Entre Ríos. 
 
Therefore,
 
THE MUNICIPAL PRESIDENT
DECREES:
 
ARTICLE  1°- The extension of the Opening of Bids is ordered, for a period of Ten (10) consecutive days, from the date set by the Directorate of Purchases and Supplies, corresponding to Public Tender No. 09/2.026, for the work “PROVISION OF MATERIALS AND LABOR FOR THE REPAVING OF RICARDO ROJAS STREETS BETWEEN CONCEJAL VEIGA AND DIAMANTE”, whose background information is in the Digital Purchase administrative case file No. 1977 of the year 2.026, by virtue of what is expressed in the preceding recitals.
 
ARTICLE 2º- Approve the new Terms and Conditions of Public Tender No. 09/2.026, for the work “PROVISION OF MATERIALS AND LABOR FOR THE REPAVING OF RICARDO ROJAS STREETS BETWEEN CONCEJAL VEIGA AND DIAMANTE”; and consequently, approve the Weighting Structure, which forms part as an Annex to this Decree.
 
ARTICLE 3°.- Forward to the Directorate of Purchases and Supplies for the purposes provided; let the Coordination of the Control and Supervision Unit and the Undersecretariat of Public Works, both of the Secretariat of Public Works, take note.
 
ARTICLE 4°.- Communicate, publish, give to the Government Secretariat; and in due course, archive.

DECREE 244/2.026.

HAVING SEEN, the Note dated 03/18/2.026, and its Annex, presented by the Coordination of the Control and Supervision Unit, dependent on the Secretariat of Public Works, in relation to the First Call for Public Tender No. 13/2.026, for the “PROVISION OF MATERIALS AND LABOR FOR THE PAVING OF DIFFERENT ARTERIES OF THE CITY OF CONCORDIA – FIRST STAGE”, approved by Decree No. 218/2.026 dated 03/11/2.026, whose background information is in the Digital Purchase administrative case file No. 2162 of the year 2.026; and,
 
CONSIDERING:
That through the aforementioned note, the technical area expresses that: “...it has not been contemplated, in the corresponding Terms and Conditions, the Price Redetermination…that in the current context, of the development of a war that is affecting the value of fuels and therefore its derivative asphalt, inputs of high incidence in this type of work, it would be necessary to include a clause that provides for it.
Indeed, in a work, with a term of 150 days, it may happen that some interested parties do not submit or estimate values that could not be adjusted to reality…”
That given this, and for the purposes of making this tender predictable, separating it from external events, the Coordination of the Control and Supervision Unit, dependent on the Secretariat of Public Works, understands it is necessary to include an Article drafted as follows:
“ARTICLE No.: PRICE REDETERMINATION: It shall be carried out in accordance with Decree No. 2.155/24 MPIyS and its Amendment Decree No. 3.480 MPIyS. As an Annex…the corresponding Weighting Structure is added.”
That for the reasons invoked, it presents a request for an extension for the submission of bids for the aforementioned work, of ten (10) consecutive days, from the day stipulated for its realization, set by the Directorate of Purchases and Supplies.
That due to the foregoing, this Municipal Executive Department deems it appropriate to grant the extension of the Opening of Bids, for a period of Ten (10) consecutive days, from the date set by the Directorate of Purchases and Supplies; as well as to approve the new Terms and Conditions, with the inclusion of an Article referring to the PRICE REDETERMINATION, which is drafted according to what was considered above, corresponding to Public Tender No. 13/2.026, for the “PROVISION OF MATERIALS AND LABOR FOR THE PAVING OF DIFFERENT ARTERIES OF THE CITY OF CONCORDIA – FIRST STAGE”, and consequently, approve the Weighting Structure, which forms part as an Annex to this Decree.

ARTICLE 2º- Approve the new Terms and Conditions, corresponding to Public Tender No. 13/2.026, for the “PROVISION OF MATERIALS AND LABOR FOR THE PAVING OF DIFFERENT ARTERIES OF THE CITY OF CONCORDIA – FIRST STAGE”.
 
ARTICLE 3°.- Approve the Weighting Structure, which forms part as an Annex to this Decree, by virtue of what was considered above.
 
ARTICLE 4°.- Forward to the Directorate of Purchases and Supplies for the purposes provided;  let the Coordination of the Control and Supervision Unit and the Undersecretariat of Public Works, dependent on the Secretariat of Public Works, take note.
 
ARTICLE 5°.- Communicate, publish, give to the Secretariat of Government and Treasury; and in due course, archive.
