CONSIDERING:
That the performing arts constitute an essential tool for the cultural strengthening of the community, stimulating sensitivity, reflection and collective identity;
That El Amateur has established itself as one of the most emblematic theatrical pieces of the last decades, having been distinguished with the Estrella de Mar Awards and at the Mercosur International Festival, which attests to its artistic excellence and significance in the cultural sphere;
That specialized critics have defined the play as a “beautiful fable in which our eyes might not believe what they see”, an experience that “teaches one to close their eyes to see, when it comes to dreams”, and a creation “full of life that gives life to the theater”, reaffirming its place as a contemporary classic;
That renowned journalists, writers and figures of national culture have highlighted its depth, emotionality and relevance, as well as the commitment of actors Mauricio Dayub and Gustavo Luppi and the impeccable direction of Luis “Indio” Romero;
That numerous interviews with the protagonists have allowed for the dissemination of the genesis of the play, its human value and its role in the construction of a national theater committed to society;

That the arrival of El Amateur in Concordia constitutes a cultural event of relevance and strengthens tourism.

SEEN:
Administrative case file No. 28,786 P. by which an Appeal is filed against Decree No. 911/25 Suspension of the Registry of Suppliers of the firms Ahora Voy S.R.L. and Partarrié Distribuciones SAS, and;
CONSIDERING:
That these proceedings were forwarded to this Deliberative Body by the interested private parties, in order to present a full copy of the Appeal filed within the framework of Ordinance No. 34,698, which is being processed in relation to the facts attributed by Decree No. 911/2025, which imposes a suspension from the Registry of Suppliers of the Municipality of Concordia on the firms Ahora Voy S.R.L. and Partarrié Distribuciones S.A.S., until their judicial situation and/or that of their owners is clarified;
That the sanction ordered by the Municipal Executive Department was based on the existence of public information and records from administrative and judicial investigations currently underway, linked to alleged irregularities and fraud against the provincial public treasury, derived from contracts and purchases of food intended for School Canteens of the Province, in which the appellant firms are mentioned;
That the Municipal Executive Department, in safeguarding the principles of transparency, suitability and good administration of public resources, resolved in a timely manner to order the suspension of the firms involved in the Municipal Registry of Suppliers until their judicial situation is clarified, with this Deliberative Body sharing such grounds;
That it must be highlighted that the requirement of suitability constitutes an essential principle in the selection processes of bidders and State contractors, a principle that is seriously compromised in the case at hand, which is why this Council cannot ignore the circumstances that gave rise to the questioned measure;
That likewise, it is not appropriate for this Body to enter into assessing the merits of the criminal and/or administrative charges that are currently under investigation by the Provincial Justice, with the analysis having to be limited to the control of the legitimacy, reasonableness and timeliness of the sanction ordered, which appears duly founded;
That with regard to the period established in Article 137 of Ordinance No. 34,698, for the filing of the appeal, it should be noted that, attending to the records of the issuance and promulgation of the appealed decree, the possibility arises that the legal term of FIFTEEN (15) days might not have been fully observed, a circumstance which, if verified, would affect the formal admissibility of the submission made;
Consequently, and in accordance with the control and oversight powers that pertain to this Deliberative Body, it is appropriate to point out that the measure adopted is of a preventive and not definitive nature, as it is subject to the resolution of the ongoing judicial and administrative processes, thus proving to be proportionate and adequate for the purpose of safeguarding the proper functioning of the Administration, public trust in state contracting, and equal conditions among state bidders;
That by virtue of the above, and in accordance with the current regulatory provisions, this Deliberative Body understands that the appeal is formally supported by the applicable regulations and the articles invoked in its grounds, and that, consequently, it is appropriate to recognize the legal relevance of its filing and the legitimacy of the request made by the appellant firms (provided that the established deadline has been met);
That, however, and for the sake of greater clarity, this Body cannot ignore that the preservation of transparency, legality, and suitability in public management constitutes an inalienable guiding principle of all administrative action, in view of the duty to protect the general interest and in accordance with the principle of reasonableness enshrined in the legal system, so that the confirmation of the measure adopted by the Executive Department is presented as the most reasonable and well-founded solution, thus guaranteeing the protection of the public interest, legal certainty, and the community's trust in its institutions.
Therefore:
THE DELIBERATIVE COUNCIL OF Concordia
ENACTS THE FOLLOWING

ARTICLE 2°.- Notify the interested parties and, once completed, forward these proceedings to the Municipal Executive Department for its knowledge and further effects.
