HAVING SEEN the background information contained in Administrative Case Files No. 2487 “D”/2024; 2584 “D”/2024; 3913 “D”/2024 and 45 “D”/2025; and,
CONSIDERING:
That the referenced administrative case files contain reports and documentation attached by the Human Resources Directorate, the Timekeeping Team, and the Occupational Health and Safety Division regarding repeated absences from the workplace by the monthly-salaried Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401, who, according to said records, has not attended his workplace to provide services on the following days:
With the absences reported by the corresponding offices being unjustified.

That from pages 2 to 8 of Administrative Case File No. 45 “D”/2025, there is an intervention by the Timekeeping Team Office, attaching a copy of the Attendance Report from the Control Unit for the periods of February and March 2024 and the clock-in/out record for the periods of June, July, August, and December 2024 of the monthly-salaried Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401.
That on page 9, the Human Resources Directorate reports that the monthly-salaried Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401, has been providing services in this municipality since 01/01/2023. He serves as monthly-salaried personnel, category 7th, reporting to the Port Operational Unit, Undersecretariat of Public Services – SDU. His service record shows no disciplinary sanctions.
That on page 10, there is the corresponding defense statement from the monthly-salaried Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401.
That on page 13, the Payroll Directorate reports that for the Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401, in the periods between July/24 and January/25, the following deductions were made:
- July/24, 2 days and the attendance and punctuality bonus.
- August/24, 7 days and the attendance and punctuality bonus.
- September/24, 20 days and the attendance and punctuality bonus.
- October/24, 17 days and the attendance and punctuality bonus.
- December/24, 10 days and the attendance and punctuality bonus.
- January/25, 16 days and the attendance and punctuality bonus.
That on page 19, the Occupational Health and Safety Division reports that the Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401, has not presented medical certificates or updated proof of medical treatments to justify his absence from the workplace during the monthly periods consulted.
That on page 19 of Administrative Case File No. 45 “D”/2025, the Legal Affairs Directorate, through Opinion No. 348/25, advises: “…to order the initiation of an Administrative Summary against the Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401, and to appoint Dr. Celina E. GONZALEZ for its instruction,…”.
That on page 20 and 20 verso, of Administrative Case File No. 45 “D”/2025, the Disciplinary Tribunal considers that: “… Due to the aforementioned, this Disciplinary Tribunal advises –by virtue of the indicated background– the instruction of an Administrative Summary against the municipal agent Araujo Elías Gabriel, Personnel File No. 9401, for presumably not having attended his usual workplace to provide services for a period exceeding fifteen days of absence in the year, without having reliably justified his actions and presumably violating the obligations that all personnel of the Municipal Administration must fulfill; conduct that would be prima facie, covered by article 16, subsection a), d) and article 31, subsection a) of Ordinance No. 11.275/49 and its amendments.”.-
That on page 21, there is an intervention by the Legal and Technical Undersecretary.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Article 107 of Provincial Law No. 10.027 and its amending Law No. 10.082 - Regime of the Municipalities of Entre Ríos. According to the Consolidated Text of Decree No. 4706/12 of the Provincial Executive Power.
Therefore,
THE MUNICIPAL PRESIDENT

ARTICLE 1°.- Order the instruction of an Administrative Summary against the monthly-salaried Agent ELIAS GABRIEL ARAUJO, Personnel File No. 9401, reporting to the Port Operational Unit, Undersecretariat of Public Services – SDU, for presumably not having attended his workplace to provide services according to the absences accredited by the Human Resources Directorate, considering the absences from the clock-in/out records of the Attendance Control System enabled for that purpose, attached from pages 2 to 8 of Administrative Case File No. 45 “D”/2025, as a presumption of absence, namely:

That from his “prima facie” conduct, a possible breach of labor obligations is inferred, potentially being covered and/or included within the provisions of Article 16, subsection a) and d) and Article 31, subsection a) of the Staffing Ordinance No. 11.275/49, and its amendments.
ARTICLE 2°.- Appoint Dr. Celina Evelyn González, from the Summary Division reporting to the Legal and Technical Undersecretariat, as Summary Instructor.

EDICT
The Municipality of the city of Concordia notifies that through Resolution No. 2589/2024 dated May 14, 2024, it has been ordered to formally notify the occupants of the layout of the public streets of the Mendieta Neighborhood, adjacent to the property of Mr. Ricardo Esteban Díaz, D.N.I. No. 13.940.440, so that within a period of FIFTEEN calendar days starting from the day following the last publication of this edict, they proceed to the immediate removal of the constructions and/or structures installed without municipal authorization. Consisting of a greenhouse and a dwelling. It is made known that the municipal intervention is limited exclusively to the layout of the affected public streets, without involving other private properties or real estate.
