HAVING REGARD TO the content of Internal Administrative Case File No. 2,352 Letter "D" of the year 2024; and,
 
CONSIDERING:
That through Decree No. 1,685/2024, dated December 10, 2024, found on pages 391 to 392, it is ordered to carry out the Third Call for Private Bidding No. 57/24, for the "ACQUISITION OF DRIVERS FOR THE REPAIR OF PUBLIC LIGHTING FIXTURES", and likewise, the approval of the new Terms and Conditions of the aforementioned Bidding, found on pages 379 to 382, for item 1, in accordance with ANNEX I, which is part of the aforementioned Decree.
That the Directorate of Purchases and Supplies has intervened within its competence.
That there is an Opening Record dated December 23, 2024, which states that the Directorate of Purchases and Supplies proceeded to open the envelope of the sole bidder of the aforementioned Bidding.
That there is documentation presented by the bidder.
That the technical area proceeded to evaluate the offer and presents the report attached on page 433 of this document.
That on page 434, there is an Opinion from the Evaluation Commission dated December 27, 2024, reporting that a single offer was presented corresponding to the firm "ALUMBRAR PATAGONICA S.R.L.", quoting the requested items for a total amount of FOUR MILLION NINE HUNDRED TWELVE THOUSAND PESOS AND 00/100 ($ 4,912,000.00).
That having analyzed the offer in its formal aspect, it is verified that it does not comply with the presentation of the following documentation requested in Article 4 of the Terms and Conditions: f) In the case of commercial companies, the following must be attached:
• certified copy of the minutes of appointment of authorities and/or documentation proving the mandate in favor of the signatory of the proposal with sufficient powers to carry out the presentation on behalf of the company and to contract in the name and representation of the same.
• Financial Statements of the last fiscal year.
g) Updated proof of registration with A.F.I.P. and the Municipality.
That, due to the above, the Evaluation Commission decides to formally notify the firm ALUMBRAR PATAGONICA S.R.L. to present the missing difference in the bid maintenance guarantee deposit; to this effect, on page 435, there is a new intervention by the Directorate of Purchases and Supplies. That on page 452, there is a new Opinion from the Evaluation Commission dated January 03, 2025, reporting that having notified the sole bidder to present the missing documentation requested in Article 40 of the Terms and Conditions, to date, it is verified that it complies with what was requested.             
That having analyzed the offer in its economic aspect, it is verified that the only offer presented turns out to be 12.29% lower than the Preventive Allocation.
That, therefore, the Evaluation Commission advises awarding the contract to the firm ALUMBRAR PATAGONICA S.R.L., For a total amount of FOUR MILLION NINE HUNDRED TWELVE THOUSAND PESOS AND 00/100 ($4,912,000.00), in accordance with what is detailed in Annex I which is part of this Decree
That the Budget Directorate has made the corresponding Preventive Allocation and the Secretariat of Cabinet Coordination and Treasury intervened within its competence, authorizing the expenditure.
That it is the decision of this Executive Department to approve the bidding procedure found in the referenced Administrative Case File, corresponding to the Third Call for Private Bidding No. 57/24 for the "ACQUISITION OF DRIVERS FOR THE REPAIR OF PUBLIC LIGHTING FIXTURES" – 3rd CALL; and consequently, to award what was requested to the firm ALUMBRAR PATAGONICA S.R.L., in accordance with the technical report attached on page 433, for a total amount of FOUR MILLION NINE HUNDRED TWELVE THOUSAND PESOS AND 00/100 ($ 4,912,000.00), and in accordance with Annex I which is part of this Decree; given the reasons invoked above.
That the issuance of the measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Article 107, subsections ñ), q) and u), of Law No. 10,027 and its Amendment - Regime of the Municipalities of Entre Ríos.
 
Therefore,
 
THE MUNICIPAL PRESIDENT
DECREES:
 
ARTICLE 1.- Approve the bidding procedure found in Internal Administrative Case File No. 2,352 Letter "D" of the year 2024, corresponding to the Third Call for Private Bidding 57/24 "ACQUISITION OF DRIVERS FOR THE REPAIR OF PUBLIC LIGHTING FIXTURES" - 3rd CALL, ordered through Decree No. 1685/2024, dated 12/10/2024.
 
ARTICLE 2°- Award the Third Call for Private Bidding 57/24, for the "ACQUISITION OF DRIVERS FOR THE REPAIR OF PUBLIC LIGHTING FIXTURES - 3rd CALL", to the firm ALUMBRAR PATAGONICA S.R.L., in accordance with the technical report attached on page 433, for a total amount of FOUR MILLION NINE HUNDRED TWELVE THOUSAND PESOS AND 00/100 ($4,912,000.00), in accordance with what is described in Annex I which is part of this Decree; given the reasons invoked above.
 
ARTICLE 3.- Charge this expenditure to the Budgetary Item:
No. 3.2.10.02.05.08.61.01  O.P. (Public Lighting Improvement) $ 4,912,000.00.- From the current expenditure budget, and must be sent to the Budget Directorate so that the necessary adjustments are made, in accordance with this expenditure.
 
ARTICLE 4.- It is ordered that the Directorate of Purchases and Supplies carry out the necessary procedures for the fulfillment of this provision.
 
ARTICLE 5.- It is ordered that through the Directorate of Purchases and Supplies, the firm ALUMBRAR PATAGONICA S.R.L., which was the successful bidder, be notified of the content of this administrative act, and proceed in due course to carry out the procedures corresponding to this award.           
 
ARTICLE 6.- Communicate, publish, give to the Government Secretariat; and in due course archive.

CONSIDERING: ... THE MUNICIPAL EXECUTIVE DEPARTMENT DECREES:
ARTICLE 1._ Apply to the investigated Agent, MARQUEZ JULIA EVANGELINA, National Identity Document No. 25,288,476, file No. 2962, dependent on the Traffic and Transport Directorate, the disciplinary sanction of DISMISSAL, given the Question of fact: That Agent Márquez, who was seconded to the Honorable Chamber of Deputies of the Province of Entre Ríos with pay according to Municipal Executive Department Resolution No. 1531/09 dated March 5, 2009; and to date, the aforementioned agent has not appeared before the Human Resources Directorate of the Municipality of Concordia to regularize her secondment, for which her salary was withheld from the period of January 2017, and was not continued to be paid in subsequent months, up to the present. Given that the inquiry was made to the Collegiate Body of the Province by means of a formal note dated March 22, 2022, and according to the report on page 2 of Municipal Case File No. 1316150/2022, Administrative Case File No. 647 CD- Julia Márquez, of the Honorable Chamber of Deputies dated May 13, 2022, it appears that there is no Administrative Act in the Provincial Administration that proves that Mrs. Julia Evangelina Márquez, D.N.I. 25,288,476, has provided and/or is providing services in the capacity of seconded staff in that Body. Therefore, the conduct of Agent Márquez, Julia Evangelina, D.N.I. 25,288,476, File No. 2962, constitutes abandonment of her workplace, materialized in the time elapsed between the cessation of salary payments and the present, without the agent having made any claim, and likewise the non-appearance of the aforementioned agent before the Human Resources Directorate of the Municipality of Concordia to regularize her secondment situation; Question of law: her conduct being incurred in the breach of Article 16, subsection a) of Ordinance No. 11.275/49 and within the scope of articles 31, subsections a), c) and h);.- Article 16 states: The obligations of the Municipal Administration personnel in any of the categories are: a) The adequate and effective personal provision of the service subject to current regulations ... b) ... c) ... d): Observe good conduct. Article 31 of Ordinance No. 11.275/49 states verbatim " ...Causes for separation from employment are: a) Unjustified absence exceeding fifteen working days in the year. b) ...c)- Lack of dignity in her public or private life, rectitude and competence in the performance of her duties. -d). Failure to comply with orders given by the superior in accordance with the Constitution, Laws, Ordinances or Regulations ... e) ... f)- ... g)... h)- Other serious faults that by their nature are considered sufficient by the Executive Department and the Disciplinary Tribunal". Article 39 of Ordinance No. 11.275/49 cites "... Without prejudice to the liability arising from common laws, the violation of her duties shall make the agent liable to disciplinary sanctions: ... f)- Dismissal.".
